    4. Deadline Passes, Industry Awaits TSA Action

November 3 marked the deadline for states to implement fingerprint based background checks for HazMat drivers under regulations promulgated by the Transportation Security Administration May 2. Despite assurances that a public notification regarding an anticipated substantial extension on the deadline was imminent, nothing has appeared in today's Federal Register and no documents have been place on public inspection for tomorrow's edition.

ATA and the American Association of Motor Vehicle Administrators, relying upon advice from TSA, cannot provide any solid recommendations to our respective members regarding any revised implementation plan or new date, other than to state that a substantial change in course is expected.

As reported last week following a presentation by TSA at ATA's Management Conference and Exhibition in San Antonio, as well as a meeting with senior trucking company leadership, we anticipate TSA will issue two notifications, one as an extension of the compliance date and a separate revised rulemaking for the procedural aspects of the background check process for HazMat-endorsed Commercial Drivers License holders.
